1.1 CONSENT: By visiting our Sites, registering for the Services, or entering the Studio, You are consenting to the information collection, use, and sharing practices described in this Privacy Policy, as modified from time to time by Us. If, for any reason, You do not agree with the content of this Privacy Policy, please stop using the Services and Sites.
1.2 THIRD-PARTY PLATFORM: Part of the Evolve Lagree Sites, our class booking and scheduling system, and some associated communications, are hosted in partnership with third-party platforms and payment processors. Accordingly, some data-handling practices are dictated by the Terms of Service and Privacy Policies of those platforms. We recommend that You read the Terms of Service and Privacy Policies of any such third-party sites or platforms that You use. This Privacy Policy applies only to the Sites and Services owned and operated by Evolve Lagree.
1.3 WHAT THIS PRIVACY POLICY DOES NOT ADDRESS: This Privacy Policy does not address the data management practices and policies of, and information usage policies of, other sites and/or integrations to which the Sites may be linked, or on which an Evolve Lagree service relies, as those third-party sites relate to their own compliance with federal, state, and local laws and regulations.
2. DATA COLLECTION & USE: We collect the personal data that You choose to provide during registration, class booking, waiver execution, and purchase transactions. As part of registering for the Services, You will need to provide Us with your full name, billing and mailing address, email address, phone number, billing and payment information, emergency contact information, and health and fitness intake information reasonably necessary to safely participate in Lagree classes and related Services. A parent or legal guardian may contact Us at any time using the contact information below to review, correct, or request deletion of their minor child's personal information, subject to Our legitimate business and legal retention needs (for example, retaining executed waivers and liability releases as required or permitted under Texas law).

If You are a parent or guardian and believe Your child under 13 has provided Us with personal information through the Sites without Your consent, please contact Us using the information below, and We will take steps to remove that information from Our systems. This Section 2.2 addresses only the online collection of information through the Sites from children under 13, and does not limit Section 2.1 above, which governs in-Studio registration and participation by minors under the consent and supervision of a parent or legal guardian.

CLIENT TERMS AND CONDITIONS
This Client Terms and Conditions (the “Agreement”) is between You, the client (“You” or “Your”), and Evolve Lagree LLC, a Texas limited liability company (“Evolve Lagree,” “Us,” or “We”), and governs Your Membership, Class Pack, and/or other purchase of services at Evolve Lagree's studios, and all related classes and services (the “Services”).
I. MEMBERSHIP AND PAYMENT:
1.1 MEMBERSHIPS, CLASS PACKS: Evolve Lagree offers recurring monthly Memberships and class packs (“Class Packs”) for its Services. Memberships automatically renew and are billed on a recurring basis until cancelled. Class Packs consist of a predetermined number of class credits to be redeemed within the time period specified at the time of purchase; unused credits are forfeited upon expiration and are non-refundable, non-transferable, and do not roll over.
1.2 PAYMENT AUTHORIZATION, AUTO-DEBIT: All Memberships, Class Packs, and incidental charges (including late cancellation and no-show fees) are processed through Mariana Tek, Evolve Lagree's third-party booking and payment platform. You must maintain a valid credit or debit card on file in Your account, and You authorize Evolve Lagree to charge that card for all Membership fees, Class Pack purchases, and incidental charges described in this Agreement. You are responsible for keeping accurate and current payment information on file; Evolve Lagree is not responsible for any bank or card-issuer fees resulting from a declined or failed charge.
1.3 REFUNDS: All sales are final. Evolve Lagree does not issue refunds for Memberships, Class Packs, or any fees described in this Agreement, except as expressly required by applicable law.
1.4 MEMBERSHIP CANCELLATION: If You wish to cancel a monthly recurring Membership, You must submit a written cancellation request to info@evolvelagree.com with thirty (30) days' advance notice of Your next billing date, or Your card on file will continue to be charged. If extenuating circumstances require You to cancel or pause Your Membership immediately, You may terminate early for a $99 early termination fee.
1.5 MEMBERSHIP FREEZE: You may freeze Your Membership for $30 per month in lieu of Your regular Membership payment, which preserves Your then-current Membership rate until You resume. To freeze Your Membership, email info@evolvelagree.com at least ten (10) days before Your next payment date. A freeze must be for a minimum of two (2) weeks and a maximum of sixty (60) days.
II. CLASS RESERVATIONS, CANCELLATIONS & ATTENDANCE:
2.1 NEW CLIENT POLICY: If this is Your first class at Evolve Lagree, please arrive at least ten (10) minutes early so that our staff can walk You through the Lagree Megaformer and explain what to expect during class. For Your safety, if You arrive after class has started, You will not be admitted to that class and will be asked to return another time; class credits will not be returned.
2.2 LATE CANCELLATION POLICY: Evolve Lagree enforces a strict eight (8) hour cancellation policy. If You reserve a spot in class and cancel less than eight (8) hours before the class start time, including switching to a different class time on the same day, You will incur a late cancellation fee of $15 if You are on an unlimited Membership, or forfeit a class credit if You are using a fixed Membership or Class Pack.
2.3 NO-SHOW POLICY: If You fail to cancel a reserved class and do not attend, or arrive more than five (5) minutes after class begins, You will incur a no-show fee of $25.
2.4 WAITLIST POLICY: Adding yourself to a class waitlist is treated the same as reserving a spot in that class; if You can no longer attend, You must remove yourself from the waitlist. If You are added to a class from the waitlist, the late cancellation and no-show policies described above will apply to You. If a spot becomes available outside the eight (8) hour cancellation window, waitlisted clients will be added to the class automatically in waitlist order. If a spot becomes available within the eight (8) hour cancellation window, all waitlisted clients will receive a text message with a link to book the spot on a first-come, first-served basis.
2.5 LATE ARRIVAL POLICY: Existing clients arriving more than five (5) minutes after class start time may be turned away, and their reserved spot may be given to a client on the waitlist; class credits will not be returned. This policy exists for Your safety and out of respect for our clients and instructors.
III. STUDIO POLICIES:
3.1 DRESS CODE: You must arrive prepared for physical activity, including grip socks (required), a towel, and water. Grip socks are available for purchase at the Studio.
3.2 AGE POLICY, MINOR PARTICIPANTS: You must be at least fourteen (14) years old to participate in Services at Evolve Lagree. Participants under sixteen (16) years old must be accompanied to the Studio by a parent or legal guardian. If You are under eighteen (18) years old, a parent or legal guardian must also execute this Agreement and the separate Liability Waiver on Your behalf before You may participate in any Services.
3.3 INSTRUCTOR SUBSTITUTION, SCHEDULE CHANGES: Evolve Lagree reserves the right to change instructors on the schedule without prior notice. While this does not happen often, our staff may occasionally have emergencies that require a substitution rather than cancelling a class outright. Refunds will not be issued based on instructor preference.
3.4 CONTENT RELEASE: You grant Evolve Lagree, its representatives, employees, and agents the right to photograph and/or video You while You are present at the Studio or participating in a class, and to use, reproduce, and publish those photographs or videos, with or without Your name, for any lawful business purpose, including marketing and promotional use, without compensation to You. If You do not wish to be included in promotional photos or videos, please notify Studio staff in writing.
3.5 COMMUNICATIONS: Evolve Lagree may message You regarding class reservations, Studio updates, and other information relevant to Your affiliation with Evolve Lagree. Message and data rates may apply. Reply HELP for help or STOP to opt out of text messages. Carriers are not liable for any delayed or undelivered messages. For support regarding these communications, contact info@evolvelagree.com. Evolve Lagree's Privacy Policy is available at https://www.evolvelagree.com/privacy-terms-conditions and is incorporated into this Agreement by reference.
IV. GENERAL TERMS:
4.1 LIABILITY WAIVER: Your participation in any class or Service at Evolve Lagree is conditioned upon Your execution of a separate Liability Waiver and Release of Claims, the terms of which are incorporated into this Agreement by reference. If You are a minor participant, a parent or legal guardian must execute the Liability Waiver on Your behalf.
4.2 FORCE MAJEURE: Evolve Lagree will not be liable for any delay, cancellation, or failure to perform its obligations under this Agreement caused by circumstances beyond its reasonable control, including acts of God, fire, severe weather, government orders or restrictions, labor disputes, utility or facility failures, or other similar events.
4.3 GOVERNING LAW, DISPUTE RESOLUTION: To the maximum extent permitted by law, this Agreement is governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. All claims and disputes arising under or relating to this Agreement shall be resolved by binding arbitration administered by the American Arbitration Association in Fort Bend County, Texas, before a single arbitrator, and judgment on the award may be entered in any court of competent jurisdiction. Arbitration under this Agreement shall proceed solely on an individual basis; You and Evolve Lagree waive any right to bring or participate in a class, collective, or representative action, and claims may not be joined or consolidated without the written consent of all parties. For any matter not subject to arbitration, You consent to the exclusive jurisdiction and venue of the state and federal courts located in Fort Bend County, Texas.
4.4 SEVERABILITY: If any provision of this Agreement is held invalid or unenforceable, that provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of this Agreement will remain in full force and effect.
4.5 ENTIRE AGREEMENT, MODIFICATION: This Agreement, together with the Liability Waiver referenced in Section 4.1 and Evolve Lagree's Privacy Policy, constitutes the entire agreement between You and Evolve Lagree regarding Your Membership and supersedes any prior agreements or understandings. Evolve Lagree may update this Agreement from time to time; Your continued use of Evolve Lagree's Services after such changes constitutes Your acceptance of the updated Agreement.
